Valuable dimension of law-making: fundamental principles

The article examines law-making and its principles through the prism of value principles, in particular, social morality. It is this approach to law-making and lawenforcement practice that the author sees as fundamental and one that eliminates contradictions in society. It is emphasized that law-making activity should be based on the concept of separation of law and law, which is laid down in the offi cial interpretation of the principle of the rule of law, given by the Constitutional Court of Ukraine. Based on the analysis of some provisions of normative legal acts, the value dimension of such principles of law-making as the rule of law and legal certainty is substantiated. The idea of legal laws and morality, as well as other aspects of the mentioned issues, were highlighted in the following studies: Professor M. Kozyubra, who investigates the issue of the distinction between law and law and their criteria; V. Kostytskyi, whose writings examine the moral content of law as the basis of legal order; O. Kostenko, the founder of the legal school of social naturalism, within which social pathologies in law are exposed; Academician N. Onishchenko studies the human-centered dimension of the legal worldview and globalist aspects of law; Yu. Shargorodsky studied social morality as a system of values, in particular, in lawmaking, etc. In addition, the problem of boundaries between moral and immoral phenomena, between freedom and permissiveness, which should become a legislative guarantee for the protection of human dignity and national identity, remains quite relevant and unexplored. In particular, the criteria to identify the law as conforming to the principle of the rule of law in the process of law-making activity require in-depth analysis. On August 24, 2023, the fundamental and long-awaited Law of Ukraine «On LawMaking Activity» was adopted, which aims to streamline law-making activity in Ukraine, strengthen interaction between participants in law-making activity in the process of preparing normative legal acts, and also defi ned the main principles of this activity. Law-making, the purpose of which is «regulating law-making activity in Ukraine, strengthening interaction between participants in law-making activity in the process of preparing normative-legal acts», should also be value-oriented even at the stage of normative design and creation of the concept of a normative-legal act. Therefore, in our opinion, the subject of law-making as its main goal should take into account the socio-cultural and moral context of public life, as well as observe and monitor the law that de facto, naturally or by virtue of tradition or custom exists in social relations, and formalize it in the form of specifi c legal norms with the aim of consolidating society and protecting natural human rights.
