The implementation of law is an anthropological context
Law, along with religion and ethics, is one of the socionormative systems of regulating human behavior. But law as a phenomenon of social reality fulfills its role only on the condition that it is implemented in social relations. Therefore, cognitive activity related to the process of law enforcement is of great scientific and practical interest.
Based on the research topic, it is proposed to consider it within such disciplines as the theory and philosophy of law, namely in the context of their anthropological, phenomenological and ontological foundations.
In connection with the above, the essential principles of law in the form of the right of force and the right of formal equality are considered. From the point of view of the concept of the realization of the right, in the first case, the authorized person uses his subjective right and fulfills or complies with the requirement on the part of the obligated person without having a counterclaim, in the second case, the authorized person is also opposed by the obligated person with the same powers of execution or compliance, but already with the presence of its own subjective right.
The above makes it possible to formulate an important methodological conclusion.
Implementation of the right is possible if it corresponds to the laws that exist in the physical and ideological dimensions of legal reality. If the right is not implemented, we cannot talk about the existence of the right, and what exists under such a name is its simulacrum.
In addition to the compliance of the law with social laws, the legitimization of the latter by society is important for its implementation. This implies an assessment by the collective subject, which is society, of the current legal order as corresponding to its moral (sometimes religious) principles. An individual's perception of the current law as fair (moral) leads to its implementation without any internal psychological obstacles for such an individual. Thus, the legitimation of the law by morality contributes to the unhindered implementation of the law and is a condition for its implementation.
If the theoretical concept of morality is associated with the individual's consciousness, is the result of awareness of its determinants, then the concept of an archetype is traditionally associated with the collective unconscious. Meanwhile, it has a significant impact on the processes of law enforcement. Thus, the archetypes of the unconscious can contribute to the assimilation of state-sanctioned norms or significantly hinder such assimilation, coming into conflict with their content. So, from the above, it becomes clear that the implementation of law becomes a real fact of legal practice, provided that its prescriptions correspond to the archetypes of the legal subconscious (unconscious), acquired by a certain ethnic group during considerable historical experience. At the same time, the goal of the state legal policy of eliminating negative archetypes of behavior and maintaining positive ones remains relevant.
