Іmperium and dominium in the doctrine of territory state (the concept of O. O. Zhilin)

Relevance. The doctrine of the territory of the state as the basis of its existence was formed at the beginning of the 19th century, at the end of the 20th century it is experiencing significant reservations related to both globalization processes and the expansion of international legal personality, which significantly intensified at the beginning of the 21st century in connection with the Russian aggression against
Ukraine, which began in 2014 with the occupation of Crimea. Therefore, the study of the process of formation of territorial rights acquires urgency and relevance.
Literature review on the topic of the study Although the problems of the territory of the state, territorial rights, do not attract active research attention, a significant amount of works by specialists in the field of political science, history, and law are devoted to individual aspects of the doctrine of territory.
Problem statement. One of the urgent tasks of the history of law as a science in the context of the threat to the existence of the state of Ukraine, caused by the aggression of the Russian Federation, is a deeper understanding of many state and legal phenomena and processes and Ukrainian from distinct Ukrainian-centric positions.
The achievements of predecessors in the study of state-forming elements, in particular the territory of the state, are of particular importance.
The purpose of the article is to study the legal significance of territory by Alexander Alekseevich Zhilin (06 (18). 01. 1880 — after 1928) and its analysis in the context of the doctrine of the territory of the state.
Presentation of the main material. The article attempts to formulate the scientist's vision of the doctrine of law, to trace its evolution and key provisions. The scientist identifies two theories of the legal understanding of territory. One understands the territory as an object of state rule. The other considers it the border of this rule.
Thus, the first (dominium) is ancient, stems from medieval teachings and consists in identifying the rights of the ruler with respect to the territory with the rights of private land ownership Another (imperium) is a theory that denies the territory as an object of any real law, first put forward and substantiated by the professor of Kyiv University V. O. Nezabytovsky in 1862. According to it, the territory is the space within which state power exists and acts. The basis of such a public-law doctrine of the territory (imperium) was the approach according to which the state rules within the territory, but not over the territory, the territory is not an object, but the boundary of the state power of the state.
Conclusions. The personified doctrine of the origins and evolution of the territory of the state presented by O. O. Zhilin has significant potential for the development of the theory of territorial sovereignty, the legal manifestation of which gave impetus to the formation of the principle of territorial integrity.
