Certain aspects of the administrative legal personality of officials of the state forest protection

Introduction. It is substantiated that the administrative legal personality of state forest protection officials consists not only in their ability to be the bearer of the powers enshrined in the norms of administrative law to implement the tasks of state forest protection, but also to implement them, as well as to be subject to legal liability for their failure to fulfill or improper fulfillment. One of the structural elements of the capacity of state forest protection officials, among others, is their obligation, as subjects of declaration under the Law of Ukraine «On Prevention of Corruption», to submit declarations in accordance with this Law, which requires the determination of an exhaustive list of such persons. The inconsistency of the legislation defining the legal status of state forest protection with modern reform processes and the need for its changes have been proven.
The aim of the article — based on an analysis of domestic legislation determining the status of state forest protection, legislation in the field of corruption prevention, to investigate certain aspects of the administrative legal personality of state forest protection officials, to propose criteria for classifying individuals as state forest protection officials of enterprises falling within the scope of management of the State Forest Agency, to substantiate the feasibility of making amendments to the relevant legislation.
Results. Criteria are proposed according to which positions of the state enterprise «Forests of Ukraine», which falls under the management of the State Forest Agency, can be attributed to officials of state forest protection as subjects of declaration in accordance with the Law of Ukraine «On Prevention of Corruption»: 1) These positions should belong to the officials of the SE «Forests of Ukraine». At the same time, the interpretation of the concept of «official» as a person endowed with organizational and managerial or administrative and economic functions is established in the doctrine of administrative law ; 2)In the internal administrative documents/job instructions of such officials of the State Enterprise «Forests of Ukraine» it must be clearly indicated that the scope of their powers includes the implementation of at least one of the main tasks of state forest protection; 3) in the absence of instructions on the performance of at least one of the main tasks of state forest protection established by Article 90 of the Forest Code and detailed in Clause 4 of the Regulation in the internal administrative documents/job description of such an official, it should be taken into account that the official has at least one of the powers officials of the state forest protection, defined by Article 91 of the Forest Code; 4) Taking into account the prescription of the second part of Article 91 of the LCU, according to which «Officials of the state forest protection may have other powers in accordance with the law», in the absence of the above-mentioned signs, it is necessary to take into account the prescription of Article 39 of the Law of Ukraine «On Hunting and Hunting».
Conclusions. According to the Anti-corruption Program of the State Enterprise «Forests of Ukraine», the task of the authorized unit for the prevention and detection of corruption is to verify the fact of the submission of declarations by the officials of the state forest protection and to notify the National Agency for the Prevention of Corruption about cases of non-submission or late submission of such declarations in the period defined by the Law of Ukraine» « On Prevention of Corruption» order. The list of state forest protection officials of the SE «Forests of Ukraine» is given in the Appendix to the Regulation. However, this Appendix is outdated and should be brought into line with the changes that have taken place in the State Enterprise «Forests of Ukraine». Until then, the list of officials of the state forest protection can be determined using the criteria proposed by us.
