Functional Purpose of the Stage of Case Initiation in the Context of Ensuring the Rule of Law in Civil Proceedings

Introduction. The rule of law is one of the determining vectors of civil procedure development. The rule of law determines legislative innovations and trends in law enforcement practice. The broad concept of the rule of law is embodied in civil procedure through a number of institutions and provisions, including access to justice. The author substantiates that ensuring the rule of law in civil proceedings has its own rules at each stage of the proceedings. And only in the aggregate, these rules can create a systemic regulation of procedural relations in the context of their compliance with modern standards.
The aim of the article. The purpose of this article is to study the functional purpose of the stage of commencement of proceedings in the context of ensuring the rule of law in civil proceedings.
Results. The functional purpose of the commencement of proceedings is to institutionalize a civil case and ensure access to justice.
Conclusions. Access to justice is aimed at ensuring that civil proceedings fulfill their functional purpose in the mechanism of legal regulation. Access to justice combines substantive and procedural aspects in its content and is an independent concept that borders and interacts with the right to a fair trial, but has its own legal nature, content and essence. The rule of law imperative in civil proceedings is consistent with the regulated nature of access to justice, aimed at ensuring that procedural mechanisms can be applied in practice only in cases where there is an objective need for them. A general criterion for compliance with the rule of law in matters of access to justice is the correspondence between the regulatory framework and practice of access to court, on the one hand, and compliance with the functional purpose of civil proceedings, on the other hand.
