The right of spouses to maintenance in the context of the decision of the Constitutional Court of Ukraine on the constitutionality of part four of article 75 of the Family code of Ukraine

Introduction. The article is devoted to a comprehensive study of the issue of spouses’ right to maintenance. Changes to current legislation resulting from the recognition of the provisions on legislative restriction of the right to alimony as unconstitutional, in particular, if a person’s income does not ensure the subsistence level, significantly change the established law enforcement practice and encourage scientific understanding of the essence of the spouses’ right to maintenance and its correlation with the right to social protection in the context of ensuring the right to an adequate standard of living.
The aim of the article is to study the right to spousal maintenance in systemic connection with the Decision of the Constitutional Court of Ukraine on the unconstitutionality of the provisions of part four of Article 75 of the Family Code of Ukraine and to formulate separate conclusions on this issue.
Results. The author defines the constitutional principles of legal relations on spousal maintenance. The author analyses the motivational part of the Decision of the Constitutional Court of Ukraine No. 1-р/2024 dated 29 October 2024. The author examines the issue of correlation between the right to spousal maintenance and the right to social protection. The author critically assesses the issue of application of state social standards in the field of family law. Attention is focused on the systemic problem of discrepancy between the formal and actual size of the subsistence minimum in Ukraine.
Conclusions. The legal basis of the spouses’ right to maintenance stems from Article 51 of the Constitution of Ukraine, which states that each spouse has equal rights and obligations in marriage and family. The spouses’ right to maintenance and the right to social protection are legal instruments of protection against socioeconomic risks. The spouses’ right to maintenance cannot be limited to the subsistence minimum, nor does it in any way replace the mechanism for exercising the constitutional right to an adequate standard of living. The absence of real social standards creates not only a gap in the guarantee of the constitutional right to social protection, but also provokes uncertainty in other areas where these standards are applied.
