Concept and system of criminal offenses against the state sovereignty of Ukraine

Introduction. Given the existential challenges for Ukraine in the context of a fullscale russian invasion aimed at the destruction of Ukrainian statehood, it is advisable to formulate a doctrinal definition of the concept of criminal offenses against state sovereignty and propose a system of such offenses, which is of great importance for the theory of criminal law, legislative activity and law enforcement practice in this area. The systematization of such acts will contribute to the definition of their essence, further improvement of legislation and an increase in the level of criminal-legal protection of state sovereignty. The aim of the article is to define the concept and system of criminal offences against the state sovereignty of Ukraine.
Results. The question of the system of criminal offences against state sovereignty is controversially addressed in the legal literature, due to the fact that only certain aspects of state sovereignty are taken into account when developing the system of the acts under consideration, and there are no clear and uniform criteria for classifying certain offences as criminal offences against state sovereignty. Despite the fact that the relevant criminal law provisions providing for liability for encroachment on state sovereignty are located in different sections of the special part of the Criminal code of
Ukraine, it is advisable to consider them in a certain systemic unity. The effectiveness of criminal law protection of state sovereignty is primarily determined by the possibility of establishing an exhaustive range of socially dangerous encroachments on the state sovereignty of Ukraine.
Any act aimed at causing damage to the constitutional order, territorial integrity and inviolability, defense capability, state, national, economic or information security of Ukraine undermines to some extent the state sovereignty of Ukraine. An act in which the state sovereignty of Ukraine, state sovereignty of Ukraine in the information sphere, economic sovereignty of Ukraine, territorial integrity and inviolability, defense capability, state, national, economic or information security of Ukraine is the main or additional object of a criminal offence shall be recognized as a criminal offence against state sovereignty. A criminal offence against state sovereignty is a socially dangerous act stipulated by the Criminal code of Ukraine, committed intentionally by a criminal offender and aimed at limiting, undermining (weakening) or losing state sovereignty of Ukraine, including state sovereignty in the information, economic and other spheres.
Conclusions. Criminal law protection of state sovereignty is ensured not only by criminal law provisions provided for in Chapter I of the special part of the Criminal code of Ukraine, but also in other chapters — IX, XIV, XV and XX of the special part of the Criminal code of Ukraine. It is worth noting that among these encroachments, some are definitely criminal offences against state sovereignty, while others are only in certain cases. In some cases, such acts directly encroach on the said object of criminal law protection, in others — indirectly. The state sovereignty of Ukraine may be the main or additional object of encroachment in the case of such acts. These criminal offences are united into a single system on the basis that they are aimed at causing damage (restriction, undermining (weakening) or loss) to such a direct object of encroachment as the state sovereignty of Ukraine.
