World legal order and international legal order in the papes of Ukrainian international lawyers

Introduction. In today’s conditions, the dynamics of international legal regulation, the transformation of relations that constitute the subject of international law, have been observed, in fact, since the middle of the twentieth century. This is accompanied by a certain terminological uncertainty, in particular, this concerns international legal order, international legal order, world legal order, as well as other related categories. At the same time, the state of doctrinal research on this issue requires generalizations, systematization, isolation of existing achievements and problems.

The aim of the article. The purpose of the article is to analyze conceptual approaches, the existing theoretical, methodological, and doctrinal basis of the world legal order and international law through the prism of scientific papers by Ukrainian international lawyers, as well as some other scholars.

Results. A thorough study and analysis of existing conceptual approaches to understanding the nature and essence, defining the world legal order and international law demonstrates the absence of unified approaches both in the scientific papers of Ukrainian international lawyers and other scholars (lawyers, political scientists, sociologists, historians). In the middle of the 20th century, the foundation of the modern Ukrainian school of international law was actually laid, whose representatives became not only world-famous scholars, but also active participants in the processes of creating international organizations, international judicial bodies, developing and adopting international documents on human rights, combating genocide, guarantees of state sovereignty in international law, ensuring law and order at the universal and regional levels, etc.

The results of the study are important for both modern theory and practice of international, increasing the effectiveness of the legal order of various dimensions, modern international legal relations, relations between states and other subjects, especially in the process of globalization, integration, digitalization, during armed conflicts, etc.

Conclusions. The article analyzes conceptual approaches, the existing theoretical, methodological, doctrinal basis of the world legal order and international law through the prism of scientific papers of Ukrainian international lawyers. It is about solving a number of tasks of a theoretical and practical nature in this direction, including in relation to the isolation of the significance of the Ukrainian school of international law, its contribution to the formation of modern science of international law, the system of civilizational legal values and mechanisms for their implementation. In particular, attention is paid to the scientific achievements of H. Lauterpacht, R. Lemkin, L. Son, V. Koretsky etc. It is emphasized that most of their concepts and scientifically sound ideas are the basis of numerous international legal acts and implemented in international law enforcement practice. Attention is also paid to the dynamics of international legal doctrines on the world legal order and international law in the papers of international lawyers researchers.

Although positivist views became widespread, H. Lauterpacht substantiated the idea of recognizing the international legal personality of the individual, expanding the sources and principles of international law, and identifying new branches and institutions in its system. That is, adherence to the natural law approach contributed to a significant transformation of the existing legal order, scientific substantiation of its conceptual foundations, practical orientation. The most weighty are the approaches of I. Lukashuk and V. Yevintov to the interpretation of international legal order, V. Vasylenko to the world legal order and world order, their correlation with international legal order, which is part of the international world order, and together with the complex of national legal orders constitutes a more complex macrosystem of world order. That is, the world legal order is a multifaceted system of relations between different states, international organizations, communities, which is based and functions on the appropriate international legal basis, its stability and dynamics are ensured by effective guarantees of peaceful coexistence and cooperation at the global, regional and other levels, in various spheres of life. The generally binding legal force of the basic principles of international law is significant, although, in our opinion, they require significant modernization, as do the institutional mechanisms of the modern world legal order and international legal order. The actual, rather than the declared state of functioning of international systems for the protection of human rights, collective security systems clearly demonstrates the effectiveness of international law, its norms and principles, and individual institutions.

In our opinion, it is important to improve and expand the theoretical, methodological, doctrinal foundations of research, therefore, taking into account the thorough developments of the Ukrainian international lawyers mentioned in the study, it is necessary to further conceptualize numerous modifications of the legal order, the introduction of general civilizational legal values, counteraction to real and potential challenges and threats, including in cyberspace, aggression etc. Among the promising areas of scientific research, it is advisable to identify the development of international legal culture, peacebuilding, international (world) digital order, etc.
