Historical and Legal Essay on the Formation of Civil Procedural Legislation in View of the Rule of Law Principle

Introduction. The article examines the main stages of development of civil procedural legislation and the implementation of European legal values reflecting the right to a fair trial in the broad historical context. In terms of the problem statement, the researcher notes that one of the goals of profound transformations is to implement the ideas of the rule of law in all areas of legal regulation. This leads to the formulation of new research tasks which cannot be successfully solved without understanding the evolutionary direction of development of national civil procedure and perception of the universally recognized values of the modern legal order, which are based on human and civil rights and freedoms, fundamental procedural guarantees and standards for their enforcement. Ultimately, it is about learning from the lessons of the past, not repeating its mistakes, and building a European state with long-standing democratic and legal traditions.

The aim of the article. The purpose of the article is to analyze the historical development of due process of law, which is an essential prerequisite for the study of new legal phenomena, including the rule of law in civil proceedings. 

Results. As a result of the study, the author concludes that the Rus Pravda initiated the formation of Ukrainian law and procedure. Having emerged on the basis of customs, Rus Pravda preferred mainly self-defense and vigilante procedures; the Statutes of the Grand Duchy of Lithuania ensured the continuity of adversarial forms of civil proceedings, and detailed the legal regulation of certain aspects of civil procedural activity with a view to compelling the parties to comply with the general procedure for civil proceedings; The characteristic features of the Hetmanate stage are: a peculiar judicial system and an extensive system of sources of law; the result of the long occupation of Ukrainian lands was the introduction of the search form of civil proceedings; in a socialist state, it is impossible to form an authoritative and independent judiciary and civil proceedings based on individual rights and freedoms. 

Conclusions. The declaration of Ukraine's independence is a new stage in the development of the judiciary and civil justice. In this sense, historical experience is the starting point for solving the accumulated problems and studying the rule of law in civil proceedings.
