Foreign experience of mediation in the public-legal sphere

The article examines foreign experience in the use of mediation in the public-legal sphere, as well as the implementation of best practices in Ukraine. In particular, the experience of using mediation in the USA, Poland, Great Britain, Germany, France, Belgium and other countries, including in resolving public-legal disputes, is studied. What models of mediation are common in foreign countries are considered. It is noted that the Law of Ukraine «On Mediation» and the Code of Administrative Procedure of Ukraine create the basis for the use of mediation in resolving public-legal disputes. At the same time, there is a need to make appropriate amendments to the Law of Ukraine «On Administrative Procedure», which will allow public bodies to use mediation in resolving disputes and conflicts in a pre-trial order, using all the advantages of mediation. One of the important obstacles to the implementation of mediation in resolving disputes and conflicts in the public-legal sphere is the lack of clear regulation of the rights and obligations of subjects of power regarding the use of mediation and making decisions based on its results. It is noted that for high-quality and proper functioning of mediation in Ukraine, it is worth borrowing the best international practices in the training of mediators, introducing academic disciplines in higher educational institutions, courses for training mediators, conducting trainings for civil servants on the advantages and possibilities of using mediation, etc.
