Features of registration of ownership rights and derived rights to land

The lack of scientific research into the specifics of registration of property rights and derived rights to land creates the need to analyze the provisions of regulatory legal acts to identify the main legal problems that regulate the procedure and features of acquiring land rights and their registration under the legislation of Ukraine.

The the aim of the article is to highlight the features of registration of ownership rights and derived rights to land.

Results. The article analyzes the provisions of regulatory legal acts that regulate the procedure for acquiring rights to a land plot. Based on the above analysis, the author identified and characterized the features that exist when registering rights to land plots. Derivatives of property rights to land have been identified and it has been proven that any derivative right to a land plot cannot arise if the land plot is not registered in the State Land Cadastre, and the right to it is in the State register of real property rights. Based on the analysis of documents required for state registration of rights to real estate, the main issues that may arise in practice during the registration of ownership rights and derived rights to land have been identified.

Conclusions. The article substantiates that significant features are characteristic of the registration of land rights for the so-called «incomplete rights» to land — land rights that arose before January 1, 2013, when the laws of Ukraine «On State Registration of Real Rights to Real Estate and Their Encumbrances» and «On the State Land Cadastre» were put into effect, which introduced the current procedure for registering rights to land plots. The article states that it is permitted to register derivative rights to land plots of state and municipal property even if the ownership rights to such plots are not registered, provided that the ownership rights of the state or territorial community are registered in the State Register of Property Rights simultaneously with the registration of derivative rights to such land plots. Сertain features of registration of rights to land plots on the basis of court decisions are analyzed. It is noted that in the absence of a court decision in the Unified State Register of Court Decisions, the state registrar of rights to real estate requests a copy of such a court decision, certified in accordance with the established procedure, from the relevant court.
