Legal aspects of digital transformation in Ukraine: current challenges and court practice

The article explores the key aspects of the legal support for digital transformation in Ukraine. It emphasizes the analysis of the existing regulatory framework that governs the implementation of electronic document circulation, digital and public electronic services. The significance of strategic acts such as the Strategy for the Digital Development of Innovative Activities in Ukraine until 2030, as well as the laws of Ukraine “On Electronic Documents and Electronic Document Circulation,” and “On Electronic Identification and Electronic Trust Services,” among others, is revealed. Particular attention is paid to court practices that demonstrate real issues related to the use of electronic documents, especially regarding compliance with the requirements for their preparation and legal validity.

The article also highlights the role of digital platforms like “Diia,” ProZorro, and the Smart City concept in ensuring effective electronic governance. The impact of martial law on accelerating digitization and adapting legislation to new conditions is analyzed. Specific emphasis is placed on the problematic aspects of digital transformation: digital inequality, challenges in the field of cybersecurity, and the protection of personal data. Through the prism of specific court cases, the necessity for improving the legal regulation in the area of digital services, particularly banking services, is illustrated.

In conclusion, it is emphasized that effective digital transformation requires a systematic approach that includes the modernization of legal mechanisms, the development of the digital skills of the population, ensuring the inclusivity of digital services, and sustainable financing of digital infrastructure.
