International Judicial Practice through the Lens of National Law Enforcement Theory

The article provides a theoretical and legal analysis of general trends in the influence of international judicial practice on national law enforcement theory, as well as the feedback arising from its conceptual interaction with international activity. It is argued that decisions of international courts and the legal positions they adopt, together with other forms of international jurisdictional activity, function as methodological factors in the transformation of law enforcement mechanisms within national legal orders. The study examines doctrinal factors that influence the content of legal norms and contribute to the formation of law enforcement standards. Methodological approaches to law enforcement are analyzed through the interpretation of judicial constructs and their doctrinal implications, including the concepts of monism, dualism, constitutional resistance, etc. The elements of law enforcement procedures are also examined, demonstrating that international practice has a comprehensive impact on law enforcement by shaping the interaction between international legal norms and the implementation of procedural standards of a fair trial. In addition, the mechanisms for enforcing decisions of jurisdictional bodies at the national level are analyzed. The article proposes a conceptual approach to understanding international judicial practice as an important factor in the development of contemporary legal practice in Ukraine. Within the framework of national law enforcement theory, it is argued that international jurisprudence — particularly international legal practice — requires doctrinal incorporation into the national law enforcement theory, which, in turn, exerts a reciprocal influence on international practice.
