Organizational basis of the functioning of legal information

In the article, the organizational foundations under which legal information is formed, accumulated, stored, and operates within the legal system are clarified. The point of departure is a critical review of widespread ideas in legal theory about the «system of law» and the «system of legislation», when they are contrasted on the basis of different «primary elements» (a rule of law and an article of a normative act). The author argues that such a separation of the substantive and formal aspects of a unified legal system reflects not the real functioning of law but rather fragments abstractly detached from one another; therefore, law should be viewed not statically but in the dynamics of social governance — as its normative component.
To explain the systemic nature of law and legal information, the general scientific concept of «system» (elements, integrity, structure, functions, and connections) is used. On this basis, the legal system appears as a normative (ideal) system whose content is formed by rules of law. The «core» of a rule is defined as the «right–duty» relationship (the disposition), and the basic element as a subjective right; understanding this relationship determines awareness of the integrity of the legal system and the systemic character of legal information. A rule performs the role of an «ideal container» in which normative managerial information is concentrated and internally structured into a hypothesis, disposition, and sanction.
The key practical conclusion is that legal information does not exist outside legal acts that serve as its carriers; it is through the provisions of acts that the governing entity conveys the normative content of decisions to their addressees. Therefore, the qualitative and quantitative parameters of the body of legal information and the
organization of its functioning depend on the systematization (taxonomy) of legal acts as a way of ordering the legal system at its external formal level. Using the Constitution of Ukraine and the Law «On Law-Making Activity» as examples, the article demonstrates terminological inconsistency and insufficient clarity in the system of acts (in particular, the correlation between the concepts «act», «legal act», «normative legal act» and «act of legislation», as well as the ambiguity of the term «decision»), which complicates access to legal information and hinders the automation of information processes. The author concludes that there is a need to improve the regulatory framework for the systematization of acts as the organizational basis for building an integral system of legal information.
