Legal Regulation of the Artificial Intelligence Domain: The Human-Centered Dimension

The article addresses the legal regulation of the artificial intelligence (AI) domain within the contemporary information society. It emphasizes that the rapid spread of AI technologies creates doctrinal, ethical, and practical challenges for legal science, including the need to reassess traditional legal mechanisms and to preserve the primacy of human rights and freedoms. The phenomenon of AI is examined as a factor affecting legal relations, legal facts, and the functioning of public authorities, while also provoking discussions about new forms of social-legal intervention, such as the emergence of digital dictatorship.
The aim of the article. The aim of the article is to substantiate the necessity of a human-centered approach to the legal regulation of AI and to demonstrate that AI governance should not be detached from the general legal principles and mechanisms constituting the modern legal order. Methods and results. Applying a doctrinal and systemic-structural method, the study analyses the legal regulation of AI as a complex system comprising legal norms, legal relations, legal facts, and acts of realization. The author argues that the detachment of AI governance from the established canon of legal regulation may result in fragmentation, normative inflation, or excessive interference with individual rights. Particular attention is devoted to the legal provision of AI as a multifaceted socio-legal phenomenon involving both state obligation and institutional measures aimed at effective implementation and protection of rights. The article further explores the distinction between legal and extra-legal intervention in the context of human rights protection, linking it to the debate on digital dictatorship and the transformation of collective and individual rights in the digital era. The feasibility of adopting a Digital Code is also considered as a prospective instrument for systematizing AI regulation.
Conclusions. The study concludes that AI integration requires coherent and human-centered legal regulation capable of reconciling technological progress with the protection of rights and legal certainty. The author stresses the necessity of developing national strategies for AI development, improving doctrinal understanding of the legal nature of AI, and strengthening socio-legal communication in the digital environment. Further academic research and normative refinement are deemed essential for the adequate and balanced regulation of the AI domain.
