Protection of the rights of peoples during war in the project of Olgerd Bochkovsky (1914–1920)

Introduction. The article attempts to analyze the scientific work of O. Bochkovsky, dedicated to the protection of the rights of peoples during war. His concept of creating an international organization the League of Nations, based on the Declaration of the Rights of Peoples to protect the sovereignty and national rights of the peoples of the former Austro-Hungarian Monarchy and the Russian Empire is examined.

Results. The issue of the need to create a legal framework for the protection of peoples’ rights in international and national law during war was one of the main ones in O. Bochkovsky’s public and scientific activities. A number of his articles and monographic studies are devoted to this issue.

The protection of the rights of the peoples of the former Austro-Hungarian Monarchy and the Russian Empire and the establishment of lasting peace, according to O. Bochkovsky, should have been ensured by the creation of the Union of Peoples on the basis of the Declaration of the Rights of Peoples (D.P.N.). The creation of the D.P.N. should be the result of collective cooperation of representatives of the peoples of the former Austro-Hungarian Monarchy and the Russian Empire, specialists in national affairs, defenders of sovereignty and the rights of peoples. The D.P.N. should be the basis for the reform of international law and the restructuring of Europe and the entire cultural world in the spirit of complete national justice and international solidarity.

Conclusions. O. Bochkovsky can be considered one of the ideological inspirers of the concept of creating a future European Union and the United Nations based on the principles of equality and self-determination of peoples and effective means of protecting the rights of peoples, in particular — the use of force and punishment for violations of international law and sovereignty. Therefore, the thoughts of the thinker regarding the construction of international relations based on the principle of national equality and equivalence are extremely relevant.

The introduction of the aforementioned works of O. Bochkovsky into scientific circulation will contribute to the further avoidance of the repetition of historical mistakes and the development of effective means and mechanisms for protecting the rights of peoples during war.
