Interaction of civil society with government institutions in the field of protecting human rights and freedoms

Abstract. It is defined in the article that the effective protection of human rights and freedoms amid modern challenges is impossible without close interaction between civil society and state institutions. Such interaction is shaped not only as a legal mechanism of participation, but also as a socio-cultural process that reflects the level of democratic maturity in society, the depth of trust in government, and the ability of citizens to influence the content and priorities of state policy. It involves not merely the passive fulfillment of state obligations, but active engagement of non-governmental organizations, human rights communities, expert circles, and local initiatives in the processes of shaping, implementing, and monitoring policies in the field of human rights. This interaction becomes especially relevant under martial law, when the state simultaneously expands its powers and is obliged to maintain a balance between security and individual rights.

Based on the generalization of the forms and mechanisms of interaction between civil society and state institutions, it is concluded that this interaction is not only an instrument of democratic governance, but also a guarantor of the effective implementation of human rights and freedoms, especially in conditions of crisis challenges — armed conflict, hybrid threats, information instability. Models of cooperation — from consultative bodies to strategic litigation — indicate a gradual evolution from formal involvement to real participation of the public in the formation of legal policy. At the same time, the effectiveness of interaction largely depends on the transparency of state structures, trust in institutions, the level of legal culture and institutional capacity of non-governmental organizations. It was found that digitalization and open forms of communication (electronic petitions, online monitoring, crowdsourcing platforms) play an increasingly important role in strengthening the accountability of authorities and mobilizing public initiatives. Accordingly, the formation of a sustainable system of partnership between civil society and the state requires a combination of normative recognition, institutional support, and active promotion of social participation. This is a key condition for strengthening the rule of law, the legitimacy of political power, and the preservation of the legal identity of Ukrainian society during the period of transformation.
