The development of administrative delict law of some post-soviet states in the process of their european integration

In the publication the author studies the development of administrative delict law of the member states of the European Union, which were republics in the former Soviet Union (Republic of Estonia, Republic of Latvia, Republic of Lithuania), candidate states for EU membership (Republic of Georgia and Republic of Moldova) and state that oficially declared european integration ambition (Republic of Armenia), which have a common history, including legislative regulation. The relevance of the study is due to the urgent need to reform the legislation on administrative offenses in the process of Ukraine’s european integration.

Most of the analyzed States replaced the soviet codes on administrative offenses and made significant changes to the legislation on administrative delicts. Significant changes happened in Republic of Estonia, where the sphere of misdemeanors was completely removed from administrative law and recognized as part of “broad penal law”. Moldova’s approach is close to the estonian one, where illegal action were renamed from “administrative offenses” to “misdemeanors”.

Latvia and Lithuania have introduced a mixed approach, where “administrative offenses” do not belong to criminal law, but criminal procedural legislation applies to proceedings in relevant cases.

In Armenia and Georgia the law on administrative offenses fully belongs to the sphere of administrative law. Estonia and Latvia have carried out a certain decoding of the components of misdemeanors, placing them in special laws. Their systematized legislative acts do not contain the components of misdemeanors, there is only a definition of the concept of illegal acts, subjects of their commission, types of penalties and the procedure for bringing to justice.

In the majority of the analyzed states, legal entities are recognized as subjects of committing the delicts or bringing to liability. There is also a clear tendency to refuse in Armenia, Latvia and Lithuania such penalty as shortterm arrest, and to refuse in Armenia, Estonia, Latvia — community service. The most common administrative penalties are warnings, fines and deprivation of a special right.
