Towards a new theory of civil procedural liability: from sanctions to guarantees of judicial efficiency

Introduction. The legislator ignores the need to develop a mechanism for civil procedural liability. One of the reasons for this situation is the insuficient theoretical development of the issue under consideration.
The aim of the article. The aim of the article is to develop a doctrinal and legislative concept of civil procedural liability, without which the effectiveness of justice in civil cases cannot be improved.
Results. The author’s vision of the essence of civil procedural liability is based on the need to introduce the concept of procedural discipline. Procedural discipline as a general procedural obligation of participants in the judicial process has a number of characteristic features, including: awareness of the need to follow the rules of civil procedural law; performing procedural actions with due regard for the conscientious fulfillment of one’s procedural obligations; the awareness that failure to comply with the procedure established by law for conducting a case or failure to perform (improper performance) procedural duties leads to adverse procedural consequences; means a positive assessment of one’s procedural activities by the state and other participants in the judicial process.
Conclusions. We propose to supplement the Civil Procedure Code of Ukraine with a provision to the following effect: civil procedural liability is the obligation established by law to behave lawfully in proceedings, as well as the adverse procedural consequences or measures of procedural coercion applied by the court to participants
in the judicial process in the event of their failure to comply with the procedure and form of procedural actions, failure to perform procedural duties, or abuse of procedural
