Special pensions in Ukraine: challenges and prospects in the context of European integration

Introduction. The issue of reforming special pension provision is a long-term structural problem that threatens the financial sustainability and stability of the pension system of Ukraine. Reforming legislation in the field of special pension provision is an integral part of Ukraine’s European integration path towards building a fair, adequate and sustainable social protection system.
The aim of the article consists of a comprehensive study of the problems of legal regulation of special pensions in Ukraine, analysis of domestic and foreign scientific sources, study of law enforcement practice and formulation of individual proposals on the issue of improving legislation in the field of special pension provision.
Results. The constitutional principles of special pensions in Ukraine are determined. The practice of the European Union member states in the field of reforming special pension provision is studied. The positions of the European Court of Human Rights and the Constitutional Court of Ukraine in the context of changing legal regulations in the field of social security are presented. It is noted that the issue of changing the size of the pension, the proportionality of the restriction or the procedure for its recalculation is based on the “requirements of social justice”, it is necessary to find a “fair balance” between the requirements of the general public interest and the requirements of protecting the fundamental rights of the individual, taking into account the actual situation in the field of pension provision in Ukraine and the financial capabilities of the state.
Conclusions. Ukraine’s European integration path is impossible without reforming special pensions and limiting the preferential regime in pension provision, which
undermines the idea of social solidarity and justice, undermines public trust in social protection. It is necessary to reform the system of special pension provision, including reducing/canceling special, preferential pensions and life support, taking into account the practice of EU countries and the development of their pension systems.
