Formation of Integrated Legal Model for Environmental Restoration of Ukraine under Conditions of Ongoing War

The article substantiates the necessity of developing an integrated legal model for environmental restoration in Ukraine under conditions of an ongoing armed conflict. It is argued that the cumulative, long-term, and often irreversible nature of war-related environmental damage makes it insufficient to consider environmental restoration solely as a post-war task. Instead, the legal framework for environmental recovery should be formed in advance, during active hostilities and asynchronous de-occupation of territories, performing preventive and stabilising functions.

The article emphasises the transformation of environmental law under wartime conditions, when it acquires restorative, compensatory, and security-oriented functions alongside traditional protective aims. This functional shift requires reconsideration of regulatory instruments and closer interaction between environmental law and securityrelated, administrative, economic, and international legal regulation. The absence of clear legal guidelines at this stage risks marginalising environmental standards in future reconstruction processes.

The integrated legal model of environmental restoration is conceptualised as a suprasectoral, systemically coordinated mechanism based on functional integration rather than the dominance of a single branch of law. The proposed model combines norms, principles, and institutions of environmental, security, administrative, economic, and international law.

The author outlines a structural framework of the model consisting of several interrelated functional blocks: a conceptual and value-based block defining the principles of environmental restoration under armed aggression; a normativeintegration block aimed at overcoming regulatory fragmentation; an organisational and governance block focused on institutional coordination; a procedural and instrumental block addressing assessment and documentation of war-related environmental damage; a compensation and restoration block linked to reparations and ecosystem recovery; and a dynamic, stage-based block reflecting wartime, transitional, and post-war phases.

The article concludes that the integrated legal model should be understood as a dynamic, multi-level system essential for ensuring environmental safety, legal certainty, and the integration of immediate security challenges with long-term sustainable development goals in Ukraine.
