Military Prosecutor's Office in the Law Enforcement System: Functions and Prospects in Ukraine

Introduction. Increased attention to the security and defense of Ukraine, the increase in the Ukrainian army, the multiple growth of budget spending on defense and security, the involvement of local budgets, volunteer funds and assistance to the Ukrainian people also increases the risks of crime in this area. Such risks require high-quality development of the military criminal justice system, where the cornerstone is the military prosecutor's ofice.

The aim of the article was to determine the place of the military prosecutor's ofice in the system of law enforcement agencies, taking into account its main functions in a prospective aspect.

Results. The separation of the military prosecutor's ofice in the system of military justice agencies of Ukraine is an urgent need in modern conditions. This is due to the need to increase military potential, ensure its internal order, which is impossible without the existence of specialized military prosecutor's ofices. The main specifics of the military prosecutor's ofice, namely the function of public prosecution in court, is implemented in relation to military criminal offenses committed by servicemen. This and other functions of the Specialized Prosecutor's Ofice will be implemented more effectively provided that it is staffed by military personnel (currently civilians) who have military experience and understand the specifics of both military-legal relations and the essence of offenses in this area.

Conclusions. In the context of a large-scale invasion of Russian troops and the legal regime of martial law, the issue of ensuring justice in the field of security and defense is of exceptional relevance. Therefore, we consider it appropriate to recommend that legislators intensify actions to strengthen the institutional capacity (independence) of the future military prosecutor's ofice. After all, it is the Specialized Military Prosecutor's Ofices within the military justice bodies that are able to ensure law and order in the field of military-legal relations and defense of Ukraine as effectively as possible. To achieve this goal, it is advisable to develop a draft regulatory legal act that will contribute to the restoration of the activities of the military prosecutor's ofice and military justice as a whole.
