Military-contextual dimension of crime determination in the sphere of radioecological security in Ukraine

Extended Abstract. The article carries out a comprehensive criminological analysis of the determinants of crime in the field of radioecological security of Ukraine in the context of armed aggression of the Russian Federation. It is substantiated that war crimes against radioecological security, including the practices of nuclear-military terrorism, are systemic in nature and are determined by a set of military-political and military-administrative factors. The key factor in the formation of relevant criminal practices is identified as the aggressive imperial-chauvinistic foreign policy of Russia, aimed at dismantling the state sovereignty of Ukraine and legitimizing mass violence, including by creating threats to nuclear and radiation security. Special attention is paid to the analysis of the context of the crime of aggression, the occupation of part of the territory of Ukraine and related war crimes, which objectively increase the risks of man-made nuclear incidents and radioactive pollution of the environment. It is established that nuclear-military terrorism acts as an instrument of political and military pressure aimed at limiting the defense capabilities of Ukraine. The role of dysfunction of international security institutions and insuficient effectiveness of international deterrence mechanisms as factors contributing to the escalation of relevant threats is separately analyzed. The conclusion is made about the need to form a specialized criminological model of countering war crimes in the field of radioecological security, integrated with the national security and defense system, and also focused on preventing the use of nuclear and radioactive objects as instruments of war.
