Administrative and legal status of subjects of public administration in the field of financial leasing

Abstract. The article is devoted to a comprehensive study of the administrative and legal status of public administration entities in the field of financial leasing in Ukraine under conditions of systemic reform of the regulatory architecture of the financial sector.
A thorough analysis of the legal nature of public administration entities in the financial sphere is carried out, and the correlation between their authoritative and service functions is revealed. Special attention is paid to the systemic classification of these entities by the scope of their competence into bodies of general and special competence, which makes it possible to identify the mechanisms for the formation and implementation of state policy in the field of financial leasing.
The administrative and legal status of the National Bank of Ukraine is analysed as the key mega-regulator which, after the liquidation of the National Commission for State Regulation of Financial Services Markets, has concentrated an unprecedented scope of authoritative powers. Four key functions of the NBU are disclosed: the registration function, which has transformed from formal record-keeping into a complex mechanism of market access involving verification of capital sources and the business model; the regulatory function, implemented through the establishment of prudential requirements, ownership structure requirements and fit-and-proper checks of managers’ business reputation; the supervisory function, exercised in the form of off-site monitoring and on-site inspections based on a risk-oriented approach; and the function of applying enforcement measures, which constitutes the most imperative manifestation of administrative coercion, with a hierarchy of sanctions ranging from preventive measures to licence revocation, as well as some other state institutions.
Key problems in the implementation of the administrative and legal status of these entities are identified: excessive regulatory discretion resulting from the use of evaluative concepts, which creates risks of violating the principle of legal certainty; a disproportionate administrative burden on small leasing companies as a result of the unification of requirements.
