The Rule of Law as an inherent characteristic of justice and a system-forming factor of Constitutional Principles of Civil Proceedings

The article is aimed at exploring the rule of law as a characteristic of justice and as a system-forming factor of constitutional principles of civil proceedings. It is proposed that cognition of the system of principles should not be limited only to civil procedural legislation and the practice of its application, but go beyond existing model of civil procedural activity.

It should be noted that despite the approaches proposed by the legislator and the updating of the system of principles of civil procedure in the 2017 edition of the Code of Civil Procedure of Ukraine, a significant role, and not only in the context of the administration of justice in civil cases, is played by a unique legal construct, recognised throughout the civilised democratic world, which today represents the prevalence of the rights, freedoms and interests of the individual, the basis of relations between the state, society and the citizen. The basic thesis is that it is unreasonable to consider the principle of the rule of law to be a procedural principle. The rule of law is an essential characteristic of civil procedure. Procedural activity that is devoid of the idea of the rule of law cannot be considered as justice. The legislator, following the theory of law and civil procedure, is unsuccessfully attempting to incorporate this legal phenomenon into the existing system of fundamental principles of civil process.

The main task of the legislator, as, indeed, the legal community, lies in a slightly different direction — the search for proper interaction between the philosophical ideal of the rule of law as the basis for the formation of ideas about justice, dignity, human rights, the normative system of principles, and judicial practice, which afirms the concepts of the rule of law through the implementation of procedural actions and making decisions. In this sense, the rule of law can rightly be considered a system-forming factor of the principles of civil proceedings.
