Legal and Ethical Dimensions of Digital Competence

The article provides a comprehensive scientific analysis of the legal and ethical dimensions of digital competence in the context of modern societal transformation. It is stated that the dynamics of digitalization require a fundamental rethinking of the role of technology, which actualizes the issue of digital competence formation as a basic condition for professional self-realization. The evolution of digital competence as a legal construct is explored: from a narrow technical skill to a complex interdisciplinary category integrating legal, ethical, and managerial determinants.

The regulatory framework for the institutionalization of digital competence in Ukraine is analyzed, particularly through the Strategy for Digital Development of Innovation Activity until 2030, industry professional standards, and special legislation. Special attention is paid to the analysis of judicial practice, which allowed for the substantiation of the status of digital competence as a qualification prerequisite and a normatively expected standard of a specialist’s professional fitness in the relevant field, as well as an inherent component of their special legal status.

The ethical and legal structure of digital competence is conceptualized as a triad of interdependent elements: cybersecurity (normative-technical aspect), digital etiquette (communicative-deontological aspect), and media literacy (cognitive-protective aspect). Three models of digital competence regulation are identified: "state imperative", "professional qualification", and "social partnership". It is proved that the convergence of legal requirements and ethical norms is a fundamental prerequisite for ensuring the legitimate subjectivity of an individual’s lawful legal subjectivity in the digital space and protecting fundamental human rights within the system of electronic public and professional communications.
